1. Purpose and Scope
ChemikalienExpo.de ("Platform") is a B2B digital expo and catalog platform where companies worldwide showcase their products, services, and corporate information. The Platform is operated by SCMist, a company registered in Canada.
These Terms & Conditions are binding on all visitors, members, and company representatives using the Platform. By using the Platform, you are deemed to have accepted these terms. Your use of the Platform constitutes a binding electronic agreement.
2. Definitions
Platform: chemikalienexpo.de
Operator: SCMist (company registered in Canada)
User: Any natural or legal person visiting or using the Platform
Visitor (L1): A person accessing the Platform without registration
Registered Member (L2): A user registered with a verified corporate email address
Company Account (L3): A company with a paid plan that publishes a catalog and profile
Content: All data including text, images, video, and documents
3. Nature of the Platform
ChemikalienExpo.de is not an e-commerce site; it does not execute sales transactions and is not responsible for commercial transactions between parties. The Platform is used solely for product/service promotion, company visibility, and B2B networking. The Platform is a lead generation and connection environment only. The Platform does not act as a broker, intermediary, or contracting party and does not directly facilitate transactions between parties.
4. No Reliance
Users acknowledge that they do not rely on the Platform for any commercial decision-making. All business decisions made based on information found on the Platform are made solely at the user's own risk and responsibility.
5. No Agency or Partnership
Nothing in these Terms creates any partnership, joint venture, agency, franchise, or employment relationship between the user and SCMist. Neither party has authority to bind the other in any way.
6. Membership and Access Levels
The Platform offers three access levels:
Visitor (L1): No registration required; access to basic content.
Registered Member (L2): Free registration with a verified corporate email; access to pricing, contact forms, and detailed content.
Company Account (L3): Paid plan; catalog publishing, company profile creation, and access to additional features.
The Platform may restrict registrations to corporate domain email addresses. Registrations using personal email services such as Gmail or Hotmail may not be accepted.
7. Account Responsibility
Users are obligated to provide accurate and up-to-date information, are responsible for account security, and may not share account credentials with third parties. The Platform may suspend or delete accounts without prior notice upon detection of false or misleading information.
8. Account Non-Transferability
User accounts may not be sold, transferred, or used by others. The Platform reserves the right to close accounts in case of violation.
9. Content Responsibility
Companies are solely responsible for all content they upload; they guarantee the accuracy of product descriptions and agree not to infringe intellectual property rights.
Prohibited content includes: misleading information, illegal products/services, intellectual property infringement, spam, and abuse.
The Platform is not obligated to pre-screen content and reserves the right to remove content upon complaint.
10. Acceptable Use Policy
Users may not engage in the following activities:
Automated data scraping or use of bots
Collecting, copying, or redistributing Platform data
Reverse engineering
Spam, misleading communications, or abuse of contact forms
Attempts to compromise system security
Use of data harvesting or collection tools
The Platform reserves the right to suspend or terminate accounts upon detection of such activities.
11. Pricing and Payment
Paid plans are offered on an annual or monthly basis.
Payments are processed securely through Stripe.
Plans renew automatically; cancellation must be made at least 7 days before the renewal date.
A 24-hour payment window applies for approved banner advertisements; slots are released to the next in queue if unpaid.
12. Refund and Cancellation Policy
Due to the digital nature of the service, refunds are generally not provided. However, a pro-rated refund may be considered where required by applicable law or where the service cannot be delivered. The Platform may offer resolution in good faith where necessary.
13. Data Protection and Privacy
The Platform complies with the following regulations:
Turkey: KVKK (Law No. 6698)
European Union: GDPR
Canada: PIPEDA
Brazil: LGPD
United States: Applicable state laws including CCPA
Users agree to the processing of their data within this scope. Users may request deletion or correction of their data at any time. The Privacy Policy applies for further details.
14. International Data Transfer
Due to the global nature of the Platform, data may be processed in different countries and cloud services may be used. In such cases, appropriate technical and administrative measures are taken and compliance with international data transfer regulations is maintained.

The Platform uses cookies to provide functionality and improve user experience. The Cookie Policy applies for further details.
16. Intellectual Property Rights
The design, logo, and content structure on the Platform belong to SCMist. Users may not copy or reproduce without permission. Company content belongs to the respective companies; the Platform holds only the right to publish.
17. Disclaimer of Warranties
The Platform is provided "as-is" and "as-available." The Platform does not guarantee uninterrupted, error-free, or continuously accessible service; does not warrant the accuracy, currency, or reliability of content; and does not guarantee that the Platform will meet user expectations. To the extent permitted by applicable law, all express or implied warranties are disclaimed.
18. Limitation of Liability
To the extent permitted by applicable law, the Platform and its operator SCMist are not liable for indirect damages (including loss of profit, business, or data) and cannot be held responsible for commercial losses arising from use of the Platform. Total liability is limited to the total amount paid by the user to the Platform in the preceding 12 months. These limitations may not apply in certain jurisdictions; in such cases, applicable local law shall govern.
19. Indemnification
The user agrees to defend and indemnify the Platform and SCMist against all claims, damages, and costs arising from uploaded content, misuse of the Platform, third-party rights violations, or unlawful activities. This includes any attorney fees and litigation costs incurred.
20. Service Changes
The Platform reserves the right to modify services, add or remove features, and update its pricing model. Significant changes will be communicated to users in advance and re-confirmation may be requested where necessary.
21. Account Suspension and Termination
Accounts may be terminated in cases of terms violation, false information, or unlawful use. Users may close their accounts at any time and request deletion of their data.
22. Emergency Service Suspension
The Platform may suspend service without prior notice in the following circumstances: security risk, system maintenance requirement, or detection of abuse. Such circumstances are not the responsibility of the Platform.
23. Force Majeure
The Platform cannot be held responsible for technical failures, natural disasters, cyberattacks, or other circumstances beyond its control.
24. Survival
The following sections survive termination of these Terms or closure of a user account: Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law and Jurisdiction.
25. Governing Law and Jurisdiction
These terms are interpreted under the laws of Ontario, Canada. Disputes will first be resolved through negotiation; if resolution cannot be achieved, they will be heard in Ontario courts. Mandatory local regulations protecting users (KVKK, GDPR, etc.) remain reserved.
26. Updates to Terms
Users will be notified when terms are updated. Re-confirmation of new terms may be requested upon login. Account access may be restricted if confirmation is not provided.
27. Language and Interpretation
These terms are available in Turkish, English, and German versions. In case of conflict, the English version shall prevail.
28. Contact
Contact with the Platform is provided through the website. Official notices are made electronically.
29. Effective Date
Anyone using the Platform is deemed to have accepted these terms. Use of the Platform constitutes a valid and binding electronic agreement.
30. Entire Agreement
These Terms constitute the entire agreement between the user and SCMist regarding use of the Platform and supersede all prior agreements, communications, or understandings.
